Jason Thompson gave a brief on the bill saying, as amended by the House Committee, it clarifies the timing of notices by the clerk of the court concerning a request for disclosure of certain affidavits or sworn testimony.

Proponent:

Honorable Jeffry Jack shared his support (Attachment 11) of the bill saying it will not put any limitation on release of the documents to the public: it does, however, give attention to when it is released.  He went on to explain that under current statute, once an arrest warrant is executed and a person is arrested, anyone can request a copy of the probable cause affidavit (PCA) from the clerk of the court. He continued that of the individuals notified each one has five days to ask the court to redact certain statutorily-defined information from the PCA or they have to ask to have it sealed. The Judge Jack explained the issues that arise with this process and explained that the bill addresses the timing issues so that a defendant's rights can be protected along with the State's interests.
