Chairman Wilborn made announcements and then opened the hearing on HB2088 - Allow use of certified drug abuse treatment program for drug severity level 4 crimes.  Jenna Moyer provided an overview of the bill. (Attachment 1)

Scott Schultz supported HB2088 indicating the Sentencing Commission introduced the bill because of the success of the program for those convicted of possessing illegal drugs.  This bill would extend the same drug treatment program to the lowest level of offenders convicted of selling illegal drugs.  The judge would have discretion in choosing whether to sentence an offender to prison or to probation and the treatment program. (Attachment 2) Mr. Schultz answered questions from the committee. 

Stuart Little provided neutral testimony on HB2088 expressing concern that the expanded program would require expanded funding or the success of the current program could be adversely affected.  Mr. Little answered questions from committee members. (Attachment 3)
