Chairperson Barker opened the hearing on HB2035.  Jason Long, Revisor, provided an overview of the bill (Attachment 1)

Chairperson Barker called upon Ed Klumpp who testified as a proponent of the bill (Attachment 2).  He introduced himself to the Committee.  This bill is a technical amendment to K.S.A. 41-106.  Last year HB 2502 was passed.  It goes into effect on April 1, 2019.  That bill authorized the Alcoholic Beverage Control (ABC) to develop regulations pertaining to beer with an alcohol content of less than six percent.  Without this revision, the ABC would not have the authority to act upon a violation that is reported to them by law enforcement.  They are also asking that this bill be placed on the Consent Calendar so that it can go into effect on April 1, 2019.

Debbi Beavers provided testimony in support of HB2035 (Attachment 3).  The ABC supports this bill.

Chairperson Barker asked if there were any other conferees who wanted to testify. There were none.  He noted that there is written testimony in support of HB2035 from The Petroleum Marketers and Convenience Store Association of Kansas (Attachment 4) and the Kansas Beer Wholesalers Association (Attachment 5).  He then closed the hearing on HB2035
