Minutes for HB2005 - Committee on Taxation

Short Title

Allowing an individual to itemize deductions in Kansas despite not itemizing on their federal return.

Dan Murray, Kansas State Director, National Federation of Independent Business testified as a proponent to HB2005.  He stated the ability to itemize is critical for small business owners regardless if they use itemized deduction on their federal tax return (Attachment 2).

 In response to a question, Mr. Siebers stated under the Kansas itemized deduction there are four items allowed as itemized deductions in Kansas. The items would be charitable contributions, medical care expenses, qualified residence interest and tax on personal property.  This is the first year that all four are 100% deductible.  

Michael Austin, Kansas Policy Institute testified as a proponent to HB2005 stating the bill would restructure the state tax law post Federal Tax Cut and Jobs Act to prevent a tax increase. He stated here are three reasons for passing HB2005 which is fairness, affordability, and for state economical competitiveness (Attachment 3).

John Wilson, Kansas Action for Children testified as an opponent to HB2005  because there would at least $50 million less going into the State General Fund and the proposal would not reduce the tax liability of low and moderate income taxpayers (Attachment 4).  

Mark Tomb, Kansas Association of Realtors testified as a proponent to HB2005  noting the bill is identical to the language that passed in SB22 which was a broad based tax reform bill that was vetoed by the Governor in 2019.  He noted the bill as written now includes an obsolete date of December 31, 2019 which will need to be amended (Attachment 5).

Eric Stafford, Kansas Chamber testified as neutral to HB2005 stating the purpose of the bill is to restore individual itemization.  He stated  the only reason the Kansas Chamber is neutral to  the bill is that corporate provisions on a the Tax Cuts and Jobs Act be included with the individual components (Attachment 12).
