Minutes for SB335 - Committee on Education

Short Title

Authorizing school districts to pay the tuition for a student's dual enrollment in a postsecondary educational institution.

Chairperson Baumgardner opened the discussion. The Chair brought to the Committee Members' attention a letter of support in their packet from Braxton Moral, a 16-year-old boy who graduated from Ulysses High School and Harvard University in the same week. (Attachment 1)

Staff gave overview of the bill.

Staff provided an amendment proposed by Senator Pyle and Senator Taylor requiring students to have an Individual Plan of Study (IPS) or Individual Education Program (IEP).(Attachment 2)

Senator Baumgardner moved the amendment; Senator Alley seconded.  The motion carried.

Staff provided an amendment excluding technical education courses and SB155 courses.(Attachment 3)

Senator Baumgardner moved the amendment; Senator Sykes seconded. The motion carried.

Staff provided an amendment insuring that students will receive high school credit toward fulfillment of the requirements for high school graduation.(Attachment 4)

Senator Rucker moved the amendment; Senator Givens seconded. The motion carried.

Staff provided an amendment correcting language to say dual and concurrent so a student earns both credits at the same time. (Attachment 5)

Senator Rucker moved the amendment; Senator Givens seconded. The motion carried.

Staff provided an amendment requiring the eligible postsecondary educational institution to notify the student if the course is not a systemwide transfer. (Attachment 6)

Senator Pyle moved the amendment; Senator Thompson seconded. The motion carried.

Staff provided an amendment requiring a tuition waiver for foster children who are dually enrolled.(Attachment 7)

Senator Baumgardner moved the amendment; Senator Rucker seconded. The motion carried.

Staff provided an amendment requires a private institution be a not-for-profit institution.(Attachment 8)

Senator Alley moved the amendment; Senator Braun seconded. The motion carried.

Staff provided an amendment requiring eligible postsecondary educational institutions report to the Legislature annually the number of students enrolled, the number of students who successfully completed the course, the tuition rate, and the State School Board is required to submit a report annually to the Legislature a summary report compiled from the institutions.(Attachment 9)

Dale Dennis, Deputy Commissioner of Education, Kansas State Depart of Education answered questions from the Committee.

An amendment was offered by Senator Thompson requiring the individual school boards to report amount they are contributing for each student.

Senator Thompson moved the friendly amendment; Senator Alley seconded. The motion carried.

An amendment was offered by Senator Pyle to require the individual school boards to report the number of foster children enrolled.

Senator Pyle moved the friendly amendment; Senator Braun seconded. The motion carried.

Senator Braun moved the amendment as amended; Senator Thompson seconded. The motion carried.

Staff provided an amendment requiring the student to be in good standing and making satisfactory progress.(Attachment 10)

Senator Braun moved the amendment; Senator Rucker seconded. The motion carried.

Chairman Baumgardner reported to the Committee she had been informed that in November 2019 the US Department of Education issued some final regulations governing the recognition of accredited agencies in other areas of Higher Education Act taking effect in July 1, 2020. Therefore, an amendment to strike the word "the" on page 2, line 17 and on line 19 strike "higher learning commission" and insert "a nationally recognized accrediting agency for higher education in the United States".

Senator Baumgardner moved the amendment; Senator Sykes seconded. The motion carried.

Senator Pyle moved an amendment to propose a substitute bill for SB335 and request a new fiscal note. Senator Braun seconded. The motion carried.
