Chairperson Patton opened the hearing on SB106. Natalie Scott provided an overview of the bill. (Attachment 9) Ms. Scott addressed questions from the membership.

Chris St. John testified in support of SB106(Attachment 10) Mr. St.John stated he appreciated the cooperation and leadership the Secretary of State's office has provided as well as the advice and assistance provided by Prof. Concannon and the Kansas Bar Association in crafting this bill. He provided information in a simplified flow chart of how a remote on-line notary might work which is in his attached written testimony. For the reasons stated above the Kansas Land Title Association supports SB106 and would encourage the committee to recommend this bill favorable for passage.

Sean Miller testified in support of SB106. (Attachment 11) Mr. Miller explained it is important to note that while remote notarizations were allowed by Executive Order (EO 20-20 and subsequent extensions) during the Covid-19 emergency that was a bare bones emergency measure. Passage of SB106 is necessary to provide the Secretary of State with rule and regulation authority to properly implement the act, and to ensure the development of a comprehensive framework for the modernization of the Kansas notary act.

Mark Tomb testified in support of SB106. (Attachment 12) Mr. Tomb said on behalf of the Kansas Association of REALTORS(R) (KAR), they want to express support for SB106, which would enact the Revised Uniform Law on Notarial Acts (RULONA). This bill provides for a long overdue modernization of notary law in Kansas.

Ronald Smith provided neutral testimony for SB106. (Attachment 18)  Mr. Smith stated he is not in opposition to bill what-so-ever. He is suggesting an amendment in his attached testimony that would allow the law the 1989 legislature enacted to use as intended. Mr. Smith stood for questions.
