Chairperson Patton opened the hearing on HB2299. Natalie Scott provided an overview of the bill and stood for questions. (Attachment 7)

Proponent

Ed Klumpp stated the organizations he represents support HB2299 which will extend the time limitations to execute a search warrant from 96 hours to 10 days. Their research found articles stating 10 days was the typical limitation across the states. They also were able to verify only one other state that has a 96-hour limitation (Illinois). Of the 19 states their research covered, they only found 2 states with a limitation under 10 days. They also found 5 states with a limitation over 10 days ranging from 14 days to 60 days. The longer periods for execution of search warrants will assist law enforcement by offering a broader time frame to choose the best time to serve the warrant based on safety considerations for the officers, the occupants of the place being sought, and others near the location the warrant is served. It also allows more opportunities to serve the warrant at a time affording the best opportunity to recover the items being searched for. Mr. Klumpp stood for questions. (Attachment 8)
