Minutes for HB2200 - Committee on Corrections and Juvenile Justice

Short Title

Allowing evidence-based program account money to be used on certain children, requiring the department of corrections to build data systems and allowing for overall case length limit extensions for certain juvenile offenders.

Chairperson Owens called for discussion and final action on HB2200.  Natalie Scott reviewed the bill.

Representative Owens proposed a technical amendment.   He explained this bill was introduced last year and by working it this year, there are a number of dates that need to be updated from 2020 to 2021.  (Attachment 2) 

Representative Owens moved to adopt the amendment, seconded by Representative Smith.  The motion carried.

Representative Howerton proposed an amendment that would expand the maximum cumulative detention days from the current of 45 days to 90 days. (Attachment 3) 

Representative Howerton moved to adopt the amendment, seconded by Representative Smith.  The motion carried.

Representative Highberger requested his "nay" vote be recorded.

Representative Howell proposed an amendment that would allow a judge to commit a juvenile to detention for a violation of probation, including a technical violation of probation, or for contempt of court and would also place caps on the detention period. (Attachment 4) 

Representative Howell moved to adopt the amendment, seconded by Representative Smith.  The motion carried.

Representative Carmichael requested his "nay" vote be recorded.

Representative Smith moved, Representative Howerton seconded, to recommend HB2200, as amended, favorably for passage.  The motion carried.

Representatives Highberger and Carmichael requested their "nay" vote be recorded.

The meeting was adjourned at 2:47 PM.
