Chairperson Barker opened the hearing on Substitute for SB34.  The Revisor provided an overview of the bill.   He referred the Committee to a document prepared by the Legislative Research Department entitled Administrative Rule and Regulation Legislative Oversight (Attachment 6).  A question was asked by Representative Highberger.

Chairperson Barker recognized Elizabeth Patton as a proponent of Substitute for SB34 (Attachment 7).  She stated that Substitute for SB34 is a critical step to address the red tape that is stifling productivity and creating barriers to economic opportunity for the citizens and businesses in Kansas.  It is also an avenue for agencies in Kansas to more effectively review and remove outdated regulations through an expedited process.

Eric Stafford testified as a proponent of Substitute for SB34 (Attachment 8).  He stated Substitute for SB34 would greatly strengthen Kansas' regulatory climate.

The Chairman allowed Randy Stookey to speak as a proponent on Substitute for SB34 (Attachment 9).  He stated this bill seeks to introduce positive changes to the regulatory system in Kansas by providing regular oversight of agency regulations by legislators directly elected by Kansas residents.  It also provides agencies a more streamlined approach to repealing regulations that are no longer deemed necessary. 

Questions were asked by Representative Highberger.

Chairperson Barker noted that there was written proponent testimony from Shahira Stafford, Kansas Cooperative Council (Attachment 10), and Jackie Newland, Kansas Livestock Association (Attachment 11).

Chairperson Barker recognized Brian Vazquez as an opponent to Substitute for SB34 (Attachment 12).  He stated that his agency is concerned about the scope of the bill.  It is unclear as to whether it only applies to state law.  His agency is also concerned about the cost of carrying out this review.  Questions were asked by Representatives Penn and Howell.

Chairperson Barker recognized David Fye as a neutral on Substitute for SB34 (Attachment 13).  He stated that his Board is concerned that the time spent drafting the comprehensive report called for in Substitute for SB34 will necessitate the agency diverting staff time away from its public protection mission.  The Board respectfully requests the BSRB be removed from the bill.

Chairperson Barker recognized James Broughel as a neutral on Substitute for SB34 (Attachment 14).  He stated that Kansas is one of eight states that do not have some process for periodically reviewing existing regulations.  Adding a periodic review process and creating fast-track procedures for removing outdated regulations are appropriate. 

Questions were asked by Representatives Arnberger, Eplee, Highberger, and Miller.  Chairperson Barker stated this bill will be worked, and he would be receptive to any amendments.

Chairperson Barker noted that there was written neutral testimony from DeAngela Burns-Wallace, Kansas Department of Administration (Attachment 15).

Chairperson Barker closed the hearing on Substitute for SB34.
