Minutes for HR6004 - Committee on Rules and Journal

Short Title

Providing the permanent rules of the House of Representatives for the 2023-2024 biennium.

Chairperson Patton called the meeting to order at 12:00 pm.

Gordon Self, Revisor of Statutes, explained the process for the adoption of the House rules. He stated that the House uses the rules from the last biennium, 2021-2022, as temporary rules until permanent rules are adopted. The House has adopted temporary rules in (2022) HR6003. The only difference from the 2021-2022 House rules contained in HR6004 is the assignment by the Speaker of standing committees in Rule 1101 and Rule 1105 for budget committees. HR6004 has been  assigned to committee and after adoption by the House, HR6004 will be the permanent rules of the House. Any questions on specific rules will be answered at this time.

Chairperson Patton referred the membership to the following written testimony that had been submitted and sent to all committee members.

Representative Humphries moved to amend HB6004 Rule 2505 (Attachment 6)- Explaining Vote, seconded by Representative Owen. Motion carried.

Representative Humphries moved to amend HB6004 Rule 2707 (Attachment 7)- Votes Required for Adoption of House Resolutions and Concurrent Resolutions, seconded by Representative Smith. Motion carried. Members requesting to have their votes recorded: No: Clayton, Highberger.

Representative Humphries moved to amend HB6004 Rule 1306 (Attachment 8)- Final action votes to be recorded in committee minutes, seconded by Representative Highberger. Motion carried. Members requesting to have their votes recorded: Yes: Clayton, Highberger.

Representative Humphries moved to amend HB6004 Rule 3301 (Attachment 9) - Speaker and Speaker Pro Tem are limited to two terms in those positions, seconded by Representative Owens. Motion carried.

Representative Owens moved to amend HB6004 Rule 2110 (Attachment 10)- Making Bill Appropriations, seconded by Representative Humphries. Motion carried. Members requested their votes be recorded: No: Highberger, Clayton.

Representative Highberger moved to amend HB6004 Rule 1304 (Attachment 11) - Introduction of Committee Bills and Resolutions, seconded by Representative Clayton. Motion carried. Members requested their votes be recorded: Yes: Highberger, Clayton.

Representative Highberger moved to amend HB6004 Rule 101 (Attachment 11) 11 - Time of Meeting, seconded by Representative Clayton. Motion failed. Members requested their votes be recorded: Yes: Highberger, Clayton, Maughan.

Representative Highberger moved to amend HB6004 Rule 1302 (Attachment 11) - Notice and Agenda for Committee Meetings, seconded by Representative Clayton. Motion failed. Members requested their votes be recorded: Yes: Highberger, Clayton.

Representative Highberger moved to amend HB6004 Rule 1306 (b) (Attachment 11) - Voting in Committee, seconded by Representative Clayton. It was clarified that this would apply to bills that had a hearing. Motion carried. Members requested their votes be recorded: Yes: Highberger, Clayton.

Representative Highberger moved to amend HB6004 Rule 1102 (Attachment 11) - Committee Appointments, seconded by Representative Clayton. A friendly amendment was made by Representative Maughan to remove the language in the amendment "except that the speaker may only replace a member of the minority party".  Motion failed. Members requested their votes be recorded: No: Highberger, Clayton, Maughan.

Representative Highberger moved to amend HB6004 Rule 1309 (Attachment 11) - Motion to Withdraw a Bill or Resolution from a Committee, seconded by Representative Clayton. Motion failed. Members requested their votes be recorded: Yes: Highberger, Clayton.

Representative Highberger moved to amend HB6004 Rule 2507 (Attachment 11) - When Roll Call Vote to be Taken, seconded by Representative Clayton. Motion failed. Members requested their votes be recorded: Yes: Highberger, Clayton.

Representative Clayton moved to amend HB6004 Rule 4305 (Attachment 12) - Open Meetings, seconded by Representative Highberger. Representative Smith made a substitute motion to remove the language beginning with "The Majority Whip may send - to the end of the original amendment. Seconded by Representative Clayton. Motion carried. Members requested their votes to be recorded: Yes: Highberger, Clayton.

Representative Owens moved to adopt HR6004 as amended. Seconded by representative Clayton. Motion carried. Members requested their votes to be recorded: Yes: Highberger, Clayton.

The meeting came to a close due to the time limitation.
