Chairperson Petersen opened the hearing on this bill.  Mr. Wells explained the bill. This bill would allow the Division of Vehicles or a contractor, as well as a county treasurer, to retain the $1.50 service fee for its work done on title applications to lienholders plus the vehicle registrations.  Under current statutes, the county treasurer receives the fee.  A $5.00 fee is charged by the counties and, under the bill, would also be charged by the Division or a contractor.  Fees collected by the Division for commercial motor vehicles would be credited to the Commercial Vehicle Administrative Fund.  In response to a question, he said this would not increase the fee, but would allow the Division of Vehicles or a contractor to collect the fees.

Deann Williams,Manager of Commercial Motor Vehicle, Kansas Department of Revenue (KDOR), gave proponent testimony (Attachment 3). She noted the work is done by KDOR but statutes do not allow the transaction fees to be retained.  In 2016, $297,709 was sent back to the counties.  If KDOR received the money it would provide enhancements to the system.  Ms. Williams explained the work done by her people division. It was asked what is the work done in the county, and she indicated she could get that information.  A question was asked about the fiscal note being $410,000, and Ms. Williams indicated she would provide an answer.

Concern was expressed that moving these funds could impact employment within the local counties.  Ms. Williams noted that if the customer is tied to another preferred office, the same money would go to the preferred office. It was noted that several counties were missing from the information, and Ms. Williams indicated a correction would be made and distributed.  She explained that if a third party did the work, they would keep the fee.

There were no opponents and no neutral testimony.
