Chairman Waymaster opened discussion on the bill.

Representative Landwehr reviewed an amendment on the bill (Attachment18).  This amendment would replace language relating to disposition of reinstatement fees, judicial branch nonjudicial salary adjustment fund.

Representative Landwehr made a motion for an amendment that would raise the reinstatement fees to $100 and all entities that are currently receiving $59 percentages would be adjusted so they would not lose funding, this amendment will increase the nonjudicial budget by approximately $1.5 million and the first $15.00 for nonjudicial salary adjustments. Representative Concannon seconded the motion.

Discussion followed by committee members regarding the motion. Jill Wolters, Office of the Revisor of Statutes, responded to questions by committee members.  She stated that the original fee was on the the DUI examination reinstatement fee and failure to pay a traffic citation. The current law is that those fees would be in affect through FY 2018. The impact on people's ability to pay the additional fee was discussed.  It was noted that the projected number of DUI's impacted by the original bill was 2,803 ,and licenses for failure to comply is approximately 36,297.  Representative Landwehr stated that the increase from $59 to $100 the remittance would be allocated as follows:  the first $15.00 to nonjudicial salaries; 29.4 percent to the Vehicles Operating fund; 22 percent to the community alcoholism intoxication program;  7.3 percent to the juvenile alternatives detention fund; and 41.1 to nonjudicial salaries.

Representative Landwehr renewed the motion.  Motion passed.

Representative Concannon made a motion for favorable passage as amended.  Representative Davis seconded the motion.  Motion passed.

Chairman reviewed the upcoming meeting agenda.
