Amending the Kansas expanded lottery act regarding racetrack gaming facilities.

Chair Bud Estes opened final action on SB427.

Senator Jeff Longbine has an amendment on SB427, the amendment is about the concern of possible breach of contract with current casino operators, dispute of how much the penalty will be and when the interest starts and when it doesn't.  Require the operator of the racetrack gaming management facility to put a line of credit up into the amount of the judgement plus interest deemed by the judgment, and strip the repayment back to the racing operator. State shares at 40% asked for it go down to 22%. The provision that is being struck down the 22% to 11% until the facility manager is repaid. This holds the state in a sound position if there is breach of contract. Seconded by Senator Ty Masterson (Attachment 50)

Senator Jeff Longbine moved to amend, amendment fails on voice vote.

Senator Jeff Longbine has an amendment on SB427, live racing dates, days shortened, simulcast racing, strike Section 9b on live racing. (Attachment 51)

Senator Jeff Longbine move to amend, seconded by Senator Ty Masterson, passed by a voice vote.

Senator Oletha Faust-Goudeau asked Whitney Damron about an agreement to getting together with the proponents and the opponents to find common ground.

Whitney Damorn said that a meeting was set in August or September for Mr. Ruffen, the meeting was canceled by Mr. Ruffin the summer of 2018. No meeting was held.

Senator Ty Masterson made a motion to table till January 15, 2019, which is non-debatable.

The motion fails.

Senator Rob Olson made a motion pass out SB427 for favorable passage, seconded by Oletha Faust-Goudeau.

The motion passes.

Senators Ty Masterson and Jeff Longbine asked to be recorded as no votes.

The meeting was adjourned at 4:28 pm.
