Chairperson Kerschen opened the hearing on SB152.

Tamera Lawrence from the Revisor of Statutes Office explained the bill.

Jaime Gaggero testified in support of the bill.  She explained that SB152 redirects fees collected by the water well program from the State General Fund to the Water Program Management Fee Fund in the Bureau of Water.  It also authorizes the Secretary of Health, Education, and Environment to establish fees for Class 1 Underground Injection Control wells and direct such fees to the existing Water Program Management Fee Fund.(Attachment 1)

Michael Gillaspie provided neutral testimony on the the bill.  He believes that there is value in giving the Secretary of KDHE the ability to create fees on Class 1 inspection wells for the purposes of permitting, monitoring, inspecting, and regulating. He does have concerns of the broad language granting the Secretary of KDHE the ability to create fees when no one knows how they will be assessed on facilities  of his company. A further concern is that this bill has the potential of increasing the costs to operate the business. (Attachment 2)
