Chairperson Kerschen opened the hearing on SB286.

Tamera Lawrence with the Revisor of Statutes Office explained the bill.

Tom Palace spoke in support of the bill.  He explained that the Kansas Underground and Above Ground Storage Tank Fund is extremely important to Kansas motor fuel distributors and retailers.It offers a pollution insurance policy that is vital to the petroleum industry due to pollution exclusions that are insurance policies.  These funds provide real financial relief to owners of petroleum tanks for the cost of corrective action at their facilities.(Attachment 7)

Randy Stookey testified in favor of the bill.  He believes that the bill is a reasonable measure and the preservation of the Underground and Above Ground Storage Tank Funds is sound public policy.(Attachment 8)

Bob Jurgens spoke in support of the bill.  He believes that the changes this bill makes to the existing statute will have a positive impact by providing funds to reimburse future cleanup activities at petroleum contaminated sites.  This is important in maintaining a healthy environment for Kansans.(Attachment 9)
