The Committee had questions and comments.

Written testimony in support of HB2518 was submitted by:

  • Ed Klumpp, Kansas Association of Chiefs of Police, Kansas Sheriffs Association, & Kansas Peace Officers Association (KACP, KSA, KPOA) (Attachment 6)
  • Sarah Rust-Martin, Kansas Coalition Against Sexual and Domestic Violence  (KCASDV) (Attachment 7)

Clayton Perkins testified in opposition of HB2518 on behalf of the Kansas Association of Criminal Defense Lawyers (KACDL). (Attachment 8)

He stated there are four reasons to oppose this bill:

  • The domestic violence designation applies to property crimes.
  • Attorneys have not been treating the domestic violence designation like it will be used to enhance domestic batteries.
  • HB2518 could interact poorly with State v. Fowler and K.S.A. 21-6810(d)(10).
  • HB2518 is likely unconstitutional.

The Committee had questions and comments.
