Creating a drug abuse treatment program for people on diversion and allowing county and district attorneys to enter into agreements with chief judges and community corrections for supervision.

Jason Thompson gave bill brief of SB3 explaining that it creates a certified drug abuse program for people on diversion and it allows county and district attorneys to work with court services or community corrections to arrange supervision of these programs. (Attachment 1)

Adam Proffitt submitted the fiscal note for SB3.(Attachment 2)

Scott Schultz submitted the prison bed space impact assessment for SB3. (Attachment 3)

Scott Schultz spoke in support of SB3 explaining the background of the bill and its advantages.  Diversion agreements are custom designed by prosecutors in their jurisdictions. Creating this at the state level provides a mechanism that prosecutors can use to create agreements with the court and to provide supervision of substance abuse offenders. (Attachment 4)

John Jenks spoke in support of SB3 explaining that this program can help offenders to maintain stable employment and to keep their records clean so they can be productive members of society in the future. (Attachment 5)

Kendall Seal spoke in support of SB3 explained the fees for the diversion can be a barrier to certain people. The fees should be eliminated. He also recommended that the scope of the bill be broadened beyond Level 5 offenses. He recommended that there be prosecutorial oversight of the program. There should be, at the least, an annual review by a supervising body.  (Attachment 6)
