The Chair opened the hearing on HB 2176.

Mr. Heim briefed the Committee on the bill.  He explained that an identical bill passed the House during the 2020 legislative session 124-1 but made it no further before the legislature adjourned.  He explained that the present bill clarifies current law by eliminating obsolete or obscure language; it outlines the process by which a property owner can vacate or exclude certain designated property.

Amanda Stanley spoke in support of the bill (Attachment 4).  She traced the history of the statute to illustrate how accretions clouded the intent of the law.  She stated that the bill more clearly outlines the hearing process and the procedures by which a property owner can address certain land use. She noted that the statute presently has no time limits; the bill stipulates a 30-day time period.
