Minutes for SB36 - Committee on Transportation

Short Title

Permitting employees of salvage vehicle pools to perform vehicle identification number inspections and salvage vehicle pools and dealers to apply for ownership documents for vehicles that are disclaimed by insurance companies.

Staff briefed the Committee on the contents of this bill. (Attachment 5)

The first proponent was John Peterson. (Attachment 6)  According to Mr. Peterson, this bill will allow a salvage pool to obtain an ownership document for the vehicle in its name if a vehicle has been brought to the lot as the subject of an insurance claim, but that claim has not been paid and the vehicle remains unclaimed on the salvage pool premises for more than 30 days.

Chairman Proehl recognized Brad Smoot as the next proponent. (Attachment 7) Mr. Smoot said this bill will allow the Kansas Highway Patrol to certify a limited number of salvage pool employees to do vehicle identification number inspections, a function done primarily by KHP and their employees.

The last proponent was Peter Greenwood.  (Attachment 8)  He said the current VIN inspection process has significant delays and can cause critical capacity issues and expense in the salvage auction industry.  Mr. Greenwood said this bill will allow for Copart and others to inspect and verify VINs by a KHP certified individual.

The Chairman recognized Captain Craig Phillips with the Kansas Highway Patrol. (Attachment 9)  Captain Phillips said their largest concern with this bill is allowing a non-law enforcement entity with a financial interest in the vehicle being inspected to perform a VIN inspection that will be changing the title status of a vehicle.

The Chairman drew the Committee's attention to the written testimony submitted in opposition to SB36 by Ed Klumpp. (Attachment 10)
