Jenna Moyer, Staff Revisor provided a brief overview of Senate Substitute for HB 2262. The legislation would add updates to the controlled substance act, as periodically required.

Alexandria Blasi, Executive Secretary, Kansas State Board of Pharmacy, asked for an amendment. She stated, last year, the board testified as a proponent of SB 298 and appreciated the committee's willingness to work the bill and place it in Senate Substitute for HB 2262. She stated the board collaborates with the Kansas Bureau of Investigation and others to  present updates to the Kansas Uniform Controlled Substances Act. The current bill is the update and it includes amending the Act to exempt all FDA-approved drug products from the definition of marijuana in K.S.A. 21-5701 and K.S.A. 65-4101. Ms. Blasi stated the amendment language must not be specific to any brand-name drug or pharmaceutical company. (Attachment 23)

Senator Baumgardner moved, seconded by Senator O'Shea, for a technical amendment to change the date from 2020 to 2021. Motion carried. (Attachment 24)

Senator Baumgardner moved, seconded by Senator O'Shea, to amend the bill adding the exemption language. Motion carried. (Attachment 25)

Senator Baumgardner moved, seconded by Senator O'Shea, to pass favorably Senate Substitute for HB 2262, as amended. Motion carried.

Chairperson Hilderbrand adjourned the meeting at 9:31 am. The next scheduled meeting is February 2, 2022.
