Chairperson Warren opened the hearing on SB395.

Jason Thompson, Senior Assistant Revisor, provided an overview of SB395. (Attachment 5) The revisor responded to questions from Committee members.

Representative Ken Corbet testified supporting SB395 stating the Kansas Department of Wildlife and Parks should adhere to the 4th Amendment of the Bill of Rights the same as the county sheriff, chief of police, and the FBI. (Attachment 6) Representative Corbet responded to questions from Committee members.

Jon Lueth testified in support of SB395 stating the bill aligns due process with the act of searching or surveilling private property. (Attachment 7)

Jackie Newland testified supporting SB395 stating Kansas Livestock members consider farmland to be of the same importance as their home and should be covered under the Fourth Amendment.Therefore, the government should have permission, a warrant, or exigent circumstances before entering to conduct surveillance to search the property. (Attachment 8)

Ms. Newland and the revisor, Mr. Thompson, responded to questions from the Committee members.

Written testimony supporting SB395 was submitted by John Donley, Kansas Farm Bureau.(Attachment 9)

Colonel Greg Kyser testified opposing SB395 stating the bill would cause a significant impact on the operations of Kansas Department of Wildlife and Parks law enforcement, jeopardize officer and public safety, as well as unknown consequences impacting the courts and those working in the field. (Attachment 10)

Colonel Kyser and the revisor, Mr. Thompson, responded to questions from the Committee members

Opponent written only testimony for SB395 was submitted by Casey Slaughter, President, Kansas State Lodge Fraternal Order of Police. (Attachment 11)
