Minutes for HB2682 - Committee on Taxation

Short Title

Validating the election held on November 2, 2021, to approve a retailers' sales tax levy by the city of Latham.

Minutes Content for Mon, Feb 21, 2022

Chairperson Smith opened the hearing on HB2682.

Adam Siebers Assistant Revisor, provided an overview on HB2682 stating the bill would validate the election that was held by the City of Latham to approve a countywide sales tax in the amount of 0.5 percent. The notice of the election was published 20 days prior to the election, instead of the required 21 days. The Department of Revenue would administer the collection and remittance of the tax and HB2682 becomes effective upon publication in the Kansas Register.  Mr. Siebers stood for questions from the Committee.

Proponent:

Representative Blex, House District 12, testified as a proponent for HB2682 stating the sales tax election passed 23 to 12, but the problem was the local newspaper delayed publication as promised and the publication was one day late which was not in compliance with Kansas statute.  He noted HB2682 will validate the election so that the City of Latham does not have to have incur expenses for another election.  (Attachment1)  Representative Blex stood for questions from Committee members.
