Minutes for SB2 - Committee on Federal and State Affairs

Short Title

Allowing consumption of beer and wine on the Kansas state fairgrounds and crediting a portion of moneys collected from the liquor enforcement tax to the state fair capital improvements fund.

Chairperson Barker asked the Committee to open their files on SB2.  Chairperson Barker stated that the Senate passed out this bill by a vote of 31-8. 

At the request of Representative Miller, the Revisor provided an overview of SB2.

Vice-Chairperson Arnberger moved to recommend SB2 favorably for passage, seconded by Representative Eplee.

Vice-Chairperson Arnberger moved to amend SB2, seconded by Representative Moser(Attachment 4)

Vice-Chairperson Arnberger stated that this amendment relates to temporary permits.  On page 5, it states that no city, county or township shall charge more than $25 each for a temporary permit.  In addition, the number of temporary permits that can be issued in a calendar year has been raised to twelve from four.  The last change states that all liquor drink taxes have to be paid before another temporary permit can be issued. 

Discussion ensued.

Representative Miller made a substitute motion to amend SB2 by adopting the amendment by Vice-Chairperson Arnberger with the additional language on page 5 that the permit fee is non-refundable, seconded by Vice-Chairperson Arnberger.

Representative Miller closed on the substitute motion to amend SB2.  Following an oral vote, the substitute amendment to SB2 was favorably passed.

Vice-Chairperson Arnberger stated that she is withdrawing her original amendment to SB2.

Representative Thomas moved to amend SB2, seconded by Vice-Chairperson Arnberger(Attachment 5)

Representative Thomas stated that this amendment allows all alcoholic liquor to be sold by a permit holder, not just wine and beer.

Discussion ensued.

Representative Thomas closed on his motion to amend SB2.  An oral vote was taken, and the amendment to SB 2 was favorably passed.

The Revisor stated that he has a technical amendment to SB2

Chairperson Barker made a motion to make a technical amendment to SB2, seconded by Representative Miller(Attachment 6).

The Revisor stated that the references to the K.S.A. 2020 supplement are being removed because there will be a new volume printed for Chapters 3, 3A and 3B to the Kansas Statutes Annotated. In addition, there is a provision dealing with open records which is a year out of date. 

Chairperson Barker closed on the amendment.  The technical amendment to SB2 was favorably passed.

Vice-Chairperson Arnberger stated that she is working with the Alcoholic Beverage Control Division and some attorneys on two other amendments that she will bring to the floor if an agreement can be reached. 

Vice-Chairperson Arnberger moved to recommend SB2, as amended, favorably for passage, seconded by Representative Eplee.

Following an oral vote, SB2, as amended, was favorably passed.
