Establishing when an occupational therapist may treat a patient without referral from a physician and requiring occupational therapists to maintain professional liability insurance.

Courtney Cyzman, General Counsel, Kansas State Board of Healing Arts, provided neutral testimony on SB440 (Attachment 2). Ms. Cyzman noted that while the Board has taken a neutral approach on the bill, there are a couple of aspects regarding patient safety that the Board would like to make known to the committee. The first is in regards to the language related to what happens when a patient is progressing. The second regards a patient returning to the therapist for the same condition or injury. Third, relates to the definition of wound care management. The Board would like a requirement to include a primary care provider notification in the the bill. While these issues exist, the Board still maintains a neutral position on the bill.

Ms. Cyzman responded to questions from the committee.
