Chairperson Warren opened the hearing on HB2299.

Jason Thompson, Senior Assistant Revisor, provided an overview of the bill and stood for questions. (Attachment 1)

Representative Resman testified in support of HB2299, stating the increase in time from 96 hours to 240 hours, like 26 other states have done, provides additional time for law enforcement to execute a search warrant more safely for law enforcement and the public. (Attachment 2) Representative Resman responded to questions from Committee members.

Ed Klumpp testified in support of HB2299, stating all the border states with Kansas use 10 days except Colorado, which uses 14 days. The increased time will assist law enforcement in the process of planning and executing the search warrants, particularly in potentially volatile situations or in the case of a raid, for example. (Attachment 3)

Greg Smith testified in support of HB2299 and supports all the reasons as stated by the previous conferees. Deputy Sheriff Smith addressed questions related to concerns about information going stale before being able to execute the warrant, thereby invalidating the warrant, stating there are well-established federal case law protections already in place to prevent that from happening. (Attachment 4)

Written only testimony in support of HB2299 was submitted by John Goodyear, General Counsel, League of Kansas Municipalities. (Attachment 5)

The conferees responded to questions from Committee members.
