Chairman Waymaster opened discussion on the bill.

Representative Francis made a motion to add language to the Board of Indigents' Services to set the maximum compensation rate at $120.00 per hour for assigned council in FY 2023.  Representative Owens seconded the motion.

Representative Francis renewed the motion.  Motion passed.

Committee members received a copy of the Salary Adjustment Proposal, which was reviewed by Representative Francis (Attachment 15).

Representative Francis made a motion to approve the salary adjustment proposal. Representative Carpenter seconded the motion.

Representative Sutton made a substitute motion that would exclude the Judicial Branch and Office of Administrative Hearings for the 5 percent salary increase in FY 2023.  Representative Wolfe Moore seconded the motion.

Representative Sutton renewed the motion.  Motion failed.

Representative Owens made a substitute motion to eliminate Item 4 of the Salary Adjustment Proposal, which identifies employees excluded from the 5 percent salary adjustments (See attachment 14).  Representative Sutton seconded the motion.

Representative Owens requested a call to question on the substitute motion.  The motion failed

Representative Francis reviewed an amendment, regarding specific agencies that were deleted by the House Appropriations Committee that had been excluded by the 5 percent salary adjustment (Attachment 16).

Representative Francis made a motion to fund the salary pay plan enhancement, which adds $48,423 SGF for the Governmental Ethics Commission, $91,802 SGF for the Kansas Sentencing Commission,$4 million SGF for the Board of Indigents' Defense Services, $3.6 million for the Highway Patrol, $1.7 million for the Kansas Bureau of Investigation (KBI), for the pay progression, and $947,000 SGF for the Forensic Scientist salaries.  Representative Estes seconded the motion.

Representative Carpenter reviewed an amendment that adds language to the Board of Pharmacy for FY 2022 and FY 2023, notwithstanding the provisions of K.S.A. 65-1685 (Attachment 17).

Representative Carpenter made a motion for an amendment that adds language to the Board of Pharmacy, which appropriates money to provide data in the prescription monitoring program to a designated representative from the Department of Health and Environment regarding authorized Medicaid Program Practitioners.  Representative Landwehr seconded the motion.

Discussion followed by committee members regarding the motion.  Jill Wolters, Office of the Revisor of Statutes, responded to questions from committee members.  She stated this amendment would cover all entities that are authorized Medicaid Program Practitioners.

Representative Carpenter renewed the motion.  Motion passed.

Representative Carpenter made a motion to add $362,213 SGF for the Early Detection Works Program, which would fill a budget shortfall through the end of FY 2022.  Representative Wolfe Moore seconded the motion.

Representative Carpenter made a motion to add language that would lapse $50 million for the FMAP waiver  into FY 2023.  Representative Ballard seconded the motion.  Motion passed.

Representative Carpenter made a motion to delete the Social Service Budget Committee recommendation that would take the Independent Living subsidy to $350 per month, after the pandemic was over.  Representative Ballard seconded the motion.

Representative Carpenter reviewed an amendment, which would appropriate SGF or special revenue funds during the fiscal year ending June 30, 2023, notwithstanding the provisions of K.S.A 38-2001 (Attachment 18).  Expenditures by the Kansas Department of Health and Environment Health Care Finance, to provide coverage under the state children's health insurance program for children residing in a household that has a gross household income not to exceed 250 percent of the federal poverty guidelines.  This amendment corrects the language in the bill from FY 2008 that referrers to 220 percent of the federal poverty guidelines.

Representative Carpenter made a motion to add $1.4 million to the Children's Health Insurance Program, which brings the federal poverty guidelines to the current level of 250 percent.   Representative Ballard seconded the motion.

Representative Landwehr made a motion to extend KanCare contracts for one year.  Representative Tarwater seconded the motion.

Representative Tarwater made a motion to add $3.094 million in the budget for the State Board of Regents Teacher Scholarship Program FY 2023.  Representative Williams seconded the motion.

Representative Corbet reviewed a Department of Wildlife and Parks proviso regarding lodging and rental facilities (Attachment 19).

Representative Corbet made a motion to approve the proviso requiring a property appraisal, proposed tax on facilities, and zoning on all existing and proposed lodging and rental facilities, and proposed premises for recreational vehicles, for a report to the Chair of House Appropriations and the Chair of the Agriculture and Natural Resources Budget by February 1, 2023.  Representative Helgerson seconded the motion.

Chairman Waymaster made a motion to add $50 million to the Department of Commerce for the Kansas Housing Resource Center. for Rural Housing Development.  Representative Helgerson seconded the motion.  Motion passed.

Representative Hoffman reviewed an amendment regarding the funding formula for community colleges and technical colleges (Attachment 20).

Representative Hoffman made a motion to approve an amendment that includes the language to fully fund community colleges and technical colleges for FY 2022, funding at 50 percent in FY 2024 and fully implement the funding formula for FY 2025.  Representative Sutton seconded the motion.

Representative Hoffman reviewed an amendment regarding Community College Projects (Attachment 21).

Representative Hoffman made a motion to approve an amendment that would take $38.5 million for the Department of Commerce University Challenge Grant Fund for the 10 Community College Projects,with secured matching gifts per award.  Representative Estes seconded the motion.

Representative Hoffman made a motion to delete $10 million from the Department of Commerce for  the University Challenge Grant, and delete $124 million from the University Challenge Grants, for further review at Omnibus.  Representative Helgerson seconded the motion.

Representative Tarwater reviewed a proviso regarding the Department of Commerce and a STAR bond district (Attachment 22).

Representative  Tarwater made a motion that the FY 2023 expenditures by the Department of Commerce would be requested for approval by the State Financial Council for issuance of any Star bond financing for the Bluehawk project in Overland Park, Kansas.  Representative Sutton seconded the motion.

Representative Hoffman made a motion to move the contents and technical amendments of HB 2588 into Sub. for SB 267, and the bill be passed favorably as a substitute bill designated as House Sub for Sub SB 267.  Representative Sutton seconded the motion.
