Minutes for HB2377 - Committee on Judiciary

Short Title

Revising the laws concerning driving under the influence, including authorizing reinstatement of a driver's license for certain persons with an ignition interlock device restriction, requiring persons with an ignition interlock device restriction to complete the ignition interlock device program before driving privileges are fully reinstated, providing for reduced ignition interlock device program costs for certain persons and modifying the criminal penalties for driving a commercial motor vehicle under the influence and driving under the influence.

Chairperson Warren called for discussion and action on HB2377.

Jason Thompson, Senior Assistant Revisor, reviewed the bill as it was passed out of Committee in 2021 and identified policy differences and sentencing amendments that potentially impact federal funding. (Attachment 3) (Attachment 4) (Attachment 5) The revisor responded to questions from Committee members and discussed a technical update amendment since the bill was carried over from the 2021 Legislative Session. (Attachment 6)     

Senator Warren moved to adopt the amendment. Senator Wilborn seconded. The motion carried.

Senator Wilborn proposed an amendment adding the contents of SB146 to HB2377 and transferring the oversight of state certification of the ignition interlock manufacturers and service providers from the Kansas Department of Revenue (KDOR) to the Kansas Highway Patrol. The revisor discussed the amendment and identified the sections that were involved to move the rules and regulations administrative function from KDOR to the Kansas Highway Patrol.(Attachment 7)

Senator Wilborn moved to adopt the amendment. Senator Bowers seconded. The motion carried.

Senator Warren proposed an amendment adding the contents of SB533 to HB2377. The revisor discussed the proposed amendment that merges the two bills and stood for questions. (Attachment 8)

Senator Warren moved to adopt the amendment. Senator Wilborn seconded. The motion carried.

Senator Haley proposed a first-time offender amendment, discussed the proposed changes, and responded to questions from Committee members. (Attachment 9)

Senator Haley moved to adopt the amendment. Senator Corson seconded. The motion failed.

With no further discussion or amendments, Chairperson Warren called for final action.

Senator Gossage moved, Senator Haley seconded, to recommend HB2377, as amended, favorably for passage. The motion carried.
