Crediting docket fees to the state general fund instead of the judicial branch docket fee fund; crediting marriage license fees and drivers' license reinstatement fees to the state general fund instead of the judicial branch nonjudicial salary adjustment fund.

Chairperson Billinger opened the hearing on HB 2541.  Jill Wolters, Office of the Revisor of Statutes, provided an overview of the bill.  (Attachment 1)

Chief Justice Marl Luckert testified in support of the bill.  This is a structural change and is not intended to change the amount budgeted.  Court fees would go into SGF and then the legislature would appropriate SGF to the Judicial Branch.  This would not impact other organizations such as the Judicial Council.  The purpose of this is to insulate the Judicial Branch from the volatility of the fee fund.  Fees are different month to month and season to season, which can cause cash flow problems.  This would provide stability and predictability for the Judicial Branch and volatility in the whole SGF is better able to handle the changes.  Chief Justice Luckert responded to questions from Committee members.  (Attachment 2)
