Minutes for SB92 - Committee on Federal and State Affairs

Short Title

Creating a procedure for appointment of delegates to a convention of the states under Article V of the Constitution of the United States and prescribing the duties and responsibilities of such delegates.

Jason Long, Office of the Revisor of Statutes, gave an overview of the bill.   He explained SB92 would create new law regarding the selection and governance of delegates to a convention of the states called pursuant to Article V of the Constitution of the United States.  Mr. Long gave background on the Article V Convention and explained the delegate selection and governance provisions in the bill. (Attachment 1)

The Chairman called for proponent testimony.

Proponent Oral Testimony

Senator Caryn Tyson spoke as a proponent of the bill.  She stated, "our Founding Fathers not only allowed state legislators the power to amend the constitution, they demanded it," and Article V Convention of States is another process available to do so.  She explained SB92 provides language to define a process in Kansas for selecting and removing delegates, protects against a runaway convention, and was the result of work proposed by The Assembly of State Legislatures and legislation passed in other states. She stated the convention should be "one state, one vote".    (Attachment 2)

Following Sen. Tyson's testimony, there was a period of questions and answers.

Opponent Oral Testimony

Shawn Meehan, Founder, Guard the Constitution, spoke as an opponent of the bill.  He stated SB92 is a sales pitch to have an Article V Convention called. He stated it's deceptive that most of the promoters assure it will be one state, one vote, but they "don't entertain anything different".  He asserted the one-state, one-vote could be changed during the convention, and that one state should not be able to tell the entire Federal convention how to operate.  (Attachment 3)

Mr. Meehan stood for a period of questions and answers.
