Minutes for HB2026 - Committee on Taxation

Chairperson opened the hearing for HB2026.

Adam Siebers, Assistant Revisor, provided an overview for HB2026 noting the bill requires the secretary of revenue to file a release of a tax warrant in the county where the warrant is docketed after payment of taxes owed. (Attachment 20)  Mr. Siebers stood for questions from Committee members.

Kathleen Smith, Kansas Department of Revenue stated HB2026 would have no impact on the State General Fund receipts.  The Department of Revenue would be required to file the release or satisfaction of the warrant between 35,000 to 50,000 taxpayers annually.   The court costs to file the release or satisfaction of the warrant is approximately $46. She noted the Department indicates the bill would require $167,160 from the State General Fund in FY2024 to implement the bill. Ms. Smith noted HB2026 would cause the department to create a new collection, tracking and payment processing system for filing all releases or satisfaction of the warrant with an effective date of July 1, 2023 that could be a problem to get implemented by then and is requesting an implementation date of January 1, 2024.  Ms. Smith stood for questions from Committee members.

 In response to a question, Jay Befort, Chief Counsel, KDOR stated the fees for all 105 counties have been unified as $46.00 for the last several years

Proponent:

Terry Taylor, O'Keefe-Wilson Abstracting Co., Inc. testified as a proponent for HB2026 noting her solution is when the taxpayer pays their tax lien, collect the $46.00 fee and file the release in the county where the lien was originally filed. This will help taxpayers with state tax warrants. (Attachment 21)  Ms. O'Keefe-Wilson stood for questions from Committee members.

 Chairperson Smith closed the hearing for HB2026.
