Eileen Ma, ROS, presented a bill brief and stood for questions.   (Attachment 3) 

 

Brock Roehler, General Counsel for State Banking Commissioner (OSBC), announced that Jim Payne, Assistant Deputy, Director of Examinations, Matt Hodges, Director of IT, and IT Examinations Manager, Kylee Fine, were all present to introduce and support the passage of SB44.  He said that this bill is a new act that provides their information technology examiners the ability to enforce the existing Federal Trade Commission's (FTC) Standards for Safeguarding Customer Information under state law.   (Attachment 4)

 

Pat Barnes, General Counsel, Kansas Automobile Dealers Association (KADA), presented oral opposition testimony to SB44.  He introduced Don McNeely, President of KADA, and also Whitney Damron, Legislative Counsel for KADA, also present to answer questions regarding their association's opposition to the bill.  Among the many reasons for their opposition was the potential for expense, over-regulation and unintended invasiveness of business operations, which are already costing dealers and customers thousands of dollars for existing compliance without the addition of more.   (Attachment 5) 

The proponent and opponent parties answered questions from all the committee members.

Seeing no other questions or comments, and no other proponent, opponent, or neutral testimony was submitted, Chairperson Longbine closed the hearing on SB44.
