Chairperson Patton opened the hearing on HB2215.  Natalie Scott provided the bill brief. (Attachment 1)

Proponent

Steven Duerst (Attachment 2) explained synthetic urine has been an increasingly popular tool for individuals to use to try and subvert a “positive” drug test. Diagnostics companies like Quest have seen a rise in the use of synthetic urine, which can easily be purchased online and in some retail establishments. Mr. Duerst said the law before the committee today would create the new definition of “drug-masking product” and would make the use of such a product a misdemeanor. Mr. Duerst asked the committee to support HB2215 to help prevent this fraudulent activity which is hurting employers who ask for these drug tests, as well as the laboratory diagnostic companies, such as Quest, who process these specimens. Mr. Duest stood for questions.

Dr. Barry Sample (Attachment 3) stated this legislation prohibits defrauding an alcohol, drug, or urine screen test and bans the sale and distribution of synthetic urine for that purpose, thereby reducing the opportunity to undermine the integrity of drug testing performed by laboratories. Similar laws are also in place in at least 18 other states. Dr. Sample stood for questions.

Opponent

Nick Reinecker (Attachment 4) (Attachment 5) (Attachment 6) stated due to the fact that first time possession of cannabis is a Class B misdemeanor, he does not agree that the use of a “drug-masking product” to mask cannabis use, regardless of possession, should be subjected to a higher violation classification. Mr. Renecker also provided additional information on this topic in the attachments. He stood for questions.
