Short Title

Amending the definition of land devoted to agricultural use for property tax purposes to include properties used as part of registered agritourism activities.

Mr. Siebers provided an overview on HB2254.  The bill would classify land devoted to agricultural land that is utilized as part of a registered agritourism activity at a registered agritourism location by a registered agritourism operator pursuant to Kansas statutes.  Such classification would apply to, but not be limited to, all land and buildings, whether permanent or temporary, that are utilized for such agritourism activity. The selling of any items by a registered agritourism operator that includes, but is not limited to, sales made from either land or buildings, would not change the classification of the land as a result of such sales. 

In response to a question, Mr. Siebers stated as the bill is drafted now would take effect July 1, 2023 noting it is unknown because the exact date is not specified.  The recommended change would be to specify tax year 2023.

Representative Corbet moved, seconded by Representative Awerkamp, to amend HB2254.  (Attachment 11)

Representative Corbet moved, seconded by Representative Awerkamp, to withdraw his amendment for HB2254.

Representative Smith moved, seconded by Representative Helgerson, to amend HB2254. (Attachment 12)

Committee discussion ensued.

Representative Smith renewed his motion to amend HB2254 be passed. Motion passed.

Representative Smith made a conceptual motion for HB2254, seconded by Representative Eplee, the provision will apply to tax year 2023 going forward. Motion passed.

Representative Hoheisel moved, seconded by Representative Eplee, the Committee recommend HB2254 be passed as amended.  Motion passed.

There being no further business, the meeting was adjourned.
