Minutes for SB13 - Committee on Education

Short Title

Permitting certain local broadcasters to provide broadcast services of a school's postseason activities notwithstanding if the state high school activities association enters into an exclusive broadcast agreement for postseason activities.

Chairman Thomas asked for final action on SB13.

Jason Long, Revisor, gave an overview of the bill. 

The Chairman offered a balloon amendment, explaining that current Kansas State High School Activities Association (KSHSAA) fees are being codified. The amendment streamlines the present policy into the bill which was referencing the stipulation for reasonable fees.  (Attachment 1)

Chairman Thomas moved, Representative Estes seconded, to amend SB13 with the balloon amendment.

Representative Rhiley moved, Representative Murphy seconded, a substitutite motion to add conceptual language to the balloon amendment on SB13 stating KSHSAA shall remit all such revenues from the fees charged to the State Treasurer to be credited to the Kansas State General Fund.

Discussion ensued. 

Representative Rhiley, with permission from the second, rescinded their substitute motion to amend.  

Following discussion, Chairman Thomas closed on his motion to amend SB13 with the balloon amendment. Motion carried.

Representative Hill moved, Representative Rhiley seconded, to amend line 22, regarding reasonable compensation, to state that no fee shall be charged for any audio or video broadcast.

Discussion ensued. 

Chairman Thomas asked for action on the amendment by Representative Hill. Representative Hill closed on his motion to amend. Motion carried.

Representative Sanders moved, Representative Hoheisel seconded, to recommend SB13 as amended favorably for passage. Motion carried.

Representatives Rhiley, Sanders and Murphy requested their votes be recorded as yes.

Representatives Goetz and Featherston asked their votes be recorded as no.

In response to questions on the bill, Jason Long noted this bill will only affect future contracts and does not terminate the present five-year contract. In the future KSHSAA could not make exclusive contracts, which would allow local stations and persons to broadcast high school games, especially the championship games. He noted that KSHSAA is a nonprofit association that represents member schools, and it is not a state agency.  KSHSAA does not receive appropriations from the State. 

Chairman Thomas adjourned the meeting at 2:00.
