Minutes for HB2302 - Committee on Agriculture and Natural Resources

Short Title

Modifying the distribution of moneys into the state water plan fund, creating the water technical assistance fund and the water projects grant fund for water-related infrastructure projects and distributing a portion of the revenue from the sales and compensating use tax to the state water plan fund.

Chairperson Ryckman reopened  final action on HB2302.

Discussion continued on the balloon amendment concerning unincorporated areas to apply for grants that Senator Francisco proposed in the previous committee meeting.

Senator Francisco moved and Senator Ware seconded to approve the balloon amendment.  Motion carried.

Senator Francisco offered a balloon amendment that would clarify the dates on page 1 in subsection a.(Attachment 1)

Senator Francisco moved and Senator Peck seconded to approve the balloon amendment.  Motion carried.

Senator Francisco proposed a balloon amendment that would allow water projects grant money to be used for USDA rural development loan repayment.(Attachment 2)

Senator Francisco moved and Senator Ware seconded to approve the balloon amendment.  Motion failed.

Senator Fagg introduced a balloon amendment that would remove the sales tax and provide $30,000,000 from the State General Fund in the first year and a statement that the legislature intends to provide $30,000,000 in the next four fiscal years.(Attachment 3)

Senator Fagg moved and Senator Wilborn seconded to approve the balloon amendment.  Motion carried.

Senator Francisco offered a conceptual amendment to amend the previous balloon by striking $30,000,000 and inserting $45,000,000,  Senator Doll seconded. After discussion, Senator Francisco suggested changing her motion by striking $45,000,000 and changing it to $35,000,000. Senator Doll, who seconded the motion, did not agree, therefore the motion died.

Senator Francisco made a  motion for a conceptual amendment to the previous balloon by striking $30,000,000 and inserting $35,000,000 in two places.  Senator Peck seconded the conceptual amendment.  Motion carried.

Senator McGinn moved to pass the bill, as amended, with revisor leeway for technical clean up .  Senator Ware seconded.

Senator Peck suggested  that a substitute bill was more appropriate and Senator McGinn withdrew her motion.

Senator McGinn moved and Senator Peck seconded to recommend favorable passage of the bill, as amended, as Senate Substitute for HB2302.  Motion carried.
